RETREAT AGREEMENT, ASSUMPTION OF RISK & RELEASE OF LIABILITY

Retreat Name: Widows in the Wild – Whistler
Dates: September 2–7, 2026
Location: Whistler, British Columbia, Canada

This Retreat Agreement (“Agreement”) is entered into between Forced Joy Project, LLC, a Michigan limited liability company (“Organizer”), and you, the participant (“Guest”).

By purchasing, registering for, or attending this retreat, including clicking “Purchase,” “Confirm,” or otherwise indicating your intent to participate, you acknowledge that you have read, understood, and agreed to be legally bound by this Agreement.

1. RETREAT DETAILS & ITINERARY

This retreat includes group lodging, guided and self-guided outdoor activities, transportation, meals, and experiences as described on the retreat sales page and in pre-retreat communications. These materials are incorporated by reference.

Itinerary is subject to change at Organizer’s discretion due to weather, safety considerations, vendor availability, trail conditions, transportation issues, or other circumstances beyond Organizer’s control.

2. ASSUMPTION OF RISK

I understand that this retreat involves physically demanding and outdoor activities, including but not limited to:

  • Moderately to highly strenuous hiking (including long mileage days, elevation gain, uneven and rugged terrain)

  • Gondola transportation (including the Peak-to-Peak Gondola)

  • Water activities such as kayaking, paddleboarding, and swimming

  • Travel by shuttle or other transportation

  • Outdoor exposure to weather, altitude, wildlife, and remote conditions

  • Spa and thermal bathing experiences

I acknowledge that participation involves inherent risks, including injury, illness, falls, drowning, altitude effects, weather hazards, transportation accidents, and unforeseen events.

I voluntarily and knowingly assume all risks, both known and unknown, associated with participation.

3. PHYSICAL FITNESS & HEALTH RESPONSIBILITY

I confirm that:

  • I am physically capable of participating in the activities described

  • I have consulted a physician if necessary and have no condition that would make participation unsafe

  • I am responsible for managing my own health, medications, hydration, nutrition, and physical limits

I agree to disclose any relevant medical conditions, allergies, injuries, or limitations prior to the retreat and to inform Organizer of any changes.

I understand that medical services may be limited or delayed due to location and circumstances.

4. EMERGENCY MEDICAL CONSENT

In the event of illness or injury, I authorize Organizer and its representatives to obtain emergency medical treatment on my behalf if deemed necessary.

I accept full financial responsibility for any medical treatment, transportation, or related expenses incurred.

5. NOT MEDICAL OR THERAPEUTIC SERVICES

I understand that Forced Joy Project and Widows in the Wild do not provide medical, psychological, or therapeutic care.

Participation does not establish a therapist-client, counselor-client, or medical relationship. The retreat is a peer-based, experiential offering focused on movement, connection, and personal reflection.

6. TRAVEL RESPONSIBILITIES & INSURANCE

I am solely responsible for:

  • Valid travel documents (passport, ID, visas if applicable)

  • Meeting entry and exit requirements

  • Arranging and maintaining appropriate travel insurance

Travel insurance is strongly encouraged and should include coverage for illness, injury, trip interruption, cancellation, and evacuation.

Failure to obtain travel insurance is at my own risk.

7. PAYMENT, CANCELLATION & NO REFUND ACKNOWLEDGMENT

I understand that retreat deposits and payments are subject to the cancellation and refund policies outlined at the time of booking.

Unless otherwise stated:

  • Deposits are non-refundable

  • Cancellations by Guest do not guarantee a refund

  • Organizer is not responsible for third-party expenses such as airfare

If Organizer cancels the retreat for commercial reasons, payments made directly to Organizer will be refunded. Organizer is not responsible for third-party costs.

8. CODE OF CONDUCT & REMOVAL

I agree to act respectfully toward other participants and retreat leaders and to follow all safety guidelines.

Organizer reserves the right to remove any participant whose behavior is unsafe, disruptive, or detrimental to the group, without refund.

9. PHOTO & MEDIA RELEASE

I grant Organizer permission to photograph or record me during the retreat and to use such media for marketing, educational, or promotional purposes.

If I prefer not to be photographed or recorded, I will notify Organizer in writing prior to the retreat.

10. RELEASE OF LIABILITY

To the fullest extent permitted by law, I release and hold harmless Forced Joy Project, Widows in the Wild, and their owners, employees, contractors, volunteers, and affiliates from any claims, demands, injuries, losses, or damages arising from or related to my participation, including those resulting from negligence.

This release applies to personal injury, illness, emotional distress, property damage, or loss.

11. INDEMNIFICATION

I agree to indemnify and defend Organizer against any claims brought by third parties arising from my actions, participation, or violation of this Agreement.

12. ARBITRATION & DISPUTE RESOLUTION

Any dispute arising out of or relating to this Agreement or the retreat shall first be attempted to be resolved in good faith between the Parties.

If unresolved, the dispute shall be submitted to binding individual arbitration in the State of Michigan. Arbitration shall be conducted by a single arbitrator and governed by Michigan law.

  • Each party shall bear their own legal costs

  • No class actions or representative claims are permitted

  • Organizer retains the right to pursue intellectual property claims in court

By agreeing to this clause, both parties waive the right to a jury trial.

13. GOVERNING LAW

This Agreement shall be governed by the laws of the State of Michigan, United States, without regard to conflict-of-law principles.

14. SEVERABILITY

If any provision of this Agreement is held unenforceable, the remaining provisions shall remain in full force and effect.

15. ACKNOWLEDGMENT

I have read this Agreement carefully. I understand that I am waiving certain legal rights by accepting it. I agree voluntarily and without coercion.
